This agreement applies as between you, the User of this Web Site and Manchester Vacs, the owner(s) of this Web Site. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these Terms and Conditions, you should stop using the Web Site immediately.

No part of this Web Site is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our payment provider sending a confirmation email to you indicating that your payment has been accepted.

1. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

“Account” means collectively the personal information, Payment Information and any credentials used by Users to access Member sections of the site and/or any communications System on the Web Site;

“Carrier” means any third party responsible for transporting purchased Goods from our Premises to customers;

“Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

“Goods” means any products that Manchester Vacs advertises and/or makes available for sale through this Web Site;

“Manchester Vacs” means Manchester Vacs, Unit 1, Stuart Rd, Bredbury, Stockport. SK6 2SR.

“Service” means collectively any online facilities, tools, services or information that Manchester Vacs makes available through the Web Site either now or in the future;

“Payment Information” means any details required for the purchase of Goods from this Web Site. This includes, but is not limited to, credit/debit card numbers, bank account numbers and sort codes;

“Purchase Information” means collectively any orders, invoices, dispatch notes, receipts or similar that may be in hard copy or electronic form;

“Premises” means our place(s) of business located at Unit 1, Stuart Rd, Bredbury, Stockport. SK6 2SR.

“System” means any online communications infrastructure that Manchester Vacs makes available through the Web Site either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;

“User” / “Users” means any third party that accesses the Web Site and is not employed by Manchester Vacs and acting in the course of their employment;

“Web Site” means the website that you are currently using (www.manchestervacs.co.uk) and any sub-domains of this site (e.g. subdomain www.manchestervacs.co.uk/DysonForum/) unless expressly excluded by their own terms and conditions.

2. Age Restrictions

Persons under the age of 18 should use this Web Site only with the supervision of an Adult. Payment Information must be provided by or with the permission of an Adult.

3. International Customers

If Goods are being ordered from outside the UK, import duties and taxes may be incurred once your Goods reach their destination. Manchester Vacs is not responsible for these charges and we undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and Manchester Vacs cannot guarantee that the packaging of your Goods will be free of signs of tampering. If we can demonstrate delivery to your country via tracking, we do not take any responsibility for non-delivery or loss within your country due to the ineptitude of your local postal service or customs authority.

4. Intellectual Property

4.1 Subject to the exceptions in Clause 6 of these Terms and Conditions, all Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Manchester Vacs, our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.

4.2 Subject to Clause 7 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Manchester Vacs.

5. Third Party Intellectual Property

5.1 Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, Copyright and Trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable.

5.2 Subject to Clause 7 you may not reproduce, copy, distribute, store or in any other fashion re-use such material unless otherwise indicated on the Web Site or unless given express written permission to do so by the relevant manufacturer or supplier.

5.3 Manufacturers and other names and part numbers are used for reference and cross reference purposes only. Products listed as a genuine part are made by the manufacturer and generic parts are listed as compatible with the manufacturer's finished model number.

8. Use of Communications Facilities

8.1 When e-mailing us, or using any other System on the Web Site, you should do so in accordance with the following rules:

8.2 You acknowledge that Manchester Vacs reserves the right to monitor any and all communications made to us or using our System.

9. Accounts

9.1 In order to purchase Goods on this Web Site you will be required to submit certain personal details and Payment Information which may vary based upon your use of the Web Site as we may not require payment information until you wish to make a purchase. By continuing to use this Web Site you represent and warrant that:

9.1.1 all information you submit is accurate and truthful;

9.1.2 you have permission to submit Payment Information where permission may be required; and

9.1.3 you will keep this information accurate and up-to-date. Your creation of any payment Account is further affirmation of your representation and warranty.

9.2 It is recommended that you do not share your Account details, particularly your username and password. Manchester Vacs accepts no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.

9.3 If you have reason to believe that your Account details have been obtained by another without consent, you should contact Manchester Vacs immediately to suspend your Account and cancel any unauthorised purchases that may be pending. Please be aware that purchases can only be cancelled until they are dispatched. In the event that an unauthorised purchase is dispatched prior to your notifying us of the unauthorised nature of the purchase, Manchester Vacs accepts no liability or responsibility and you should make contact with the Carrier detailed in the Purchase Information.

10. Termination and Cancellation

10.1 Manchester Vacs reserves the right to cancel purchases without stating reasons, for any reason prior to processing payment and dispatch.

10.2 If purchases are cancelled for any reason prior to dispatch you will be refunded any monies paid in relation to those purchases.

11. Goods, Pricing and Availability

11.1 Whilst every effort has been made to ensure that all graphical representations and descriptions of Goods available from Manchester Vacs correspond to the actual Goods, Manchester Vacs is not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Goods, not different Goods altogether. Please refer to our Returns Policy below for incorrect Goods.

11.2 Where appropriate, you may be required to select the required [size] [model] [colour] [number] [other features] of the Goods that you are purchasing.

11.3 Manchester Vacs does not represent or warrant that such Goods will be available. Stock indications may be provided on the Web Site, however these may not take into account sales that have taken place during your visit to the web site.

11.4 All pricing information on the Web Site is correct at the time of going online. Manchester Vacs reserves the right to change prices and alter or remove any special offers from time to time and as necessary.

11.5 All prices on the Web Site include any necessary VAT.

11.6 We encourage you to ensure all spare parts are fitted by a competent person in accordance with manufacturer specifications. Manchester Vacs cannot be held liable for any damage caused by the fitting of a spare part. Please ensure that you have read your warranty conditions before attempting to install a part or otherwise repair your appliance. Manchester Vacs cannot be held responsible if the appliance is damaged or your warranty is voided. Some manufacturer guarantees may be on condition that you use a qualified technician.

12. Delivery

12.1 Manchester Vacs, or a third party carrier such as UPS, may notify you by way of email when your goods are to be dispatched to you. The message will contain details of estimated delivery times in addition to any reasons for a delay in the delivery of the Goods purchased by you. Further delivery information can be found >>here<<.

12.2 If Manchester Vacs receives no communication from you, within 7 working days of delivery, regarding any problems with the Goods, you are deemed to have received the Goods in full working order and with no problems.

12.3 Manchester Vacs will ship your item in what we consider to be the most expedient and secure method. We may use regular mail, Recorded Delivery or a courier at our discretion. With items that are sent by courier or a signed-for mail service, that company's proof of delivery is binding as proof of delivery. Where low value items are sent using regular mail, we always obtain proof of posting. This can be supplied upon request in order that you may contact the Post Office directly in the rare event of delayed or non delivery. Manchester Vacs are not responsible for items lost by Royal Mail if you elected "free delivery" during checkout.

12.4 Manchester Vacs accepts no responsibility for you inputting the incorrect address during checkout (or having out-of-date details if you are a Paypal user). If we ship to an address that you later inform us is partially or totally incorrect, but it is the address that you specified during checkout, the responsibility lies with you to chase the Post Office/courier/occupants of address you specified to correct your mistake. 'Item not received' claims will not be entertained in these circumstances.

13. Disclaimers

13.1 Manchester Vacs makes no warranty or representation that the Web Site will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Services.

13.2 No part of this Web Site is intended to constitute advice and the Content of this Web Site should not be relied upon when making any decisions or taking any action of any kind.

13.3 No part of this Web Site is intended to constitute a contractual offer capable of acceptance.

14. Changes to the Service and these Terms and Conditions

Manchester Vacs reserves the right to change the Web Site, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Web Site following the changes. If Manchester Vacs is required to make any changes to Terms and Conditions relating to sale of Goods by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

15. Availability of the Web Site

The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and/or faults. To the maximum extent permitted by the law, we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. Manchester Vacs accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

16. Limitation of Liability

16.1 To the maximum extent permitted by law, Manchester Vacs accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.

16.2 Nothing in these Terms and Conditions excludes or restricts Manchester Vacs’s liability for death or personal injury resulting from any negligence or fraud on the part of Manchester Vacs.

16.3 Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

17. No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

18. Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

19. Notices

All notices/communications shall be given to us either by post to our Premises (see address above) or by email to here. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day, and on the next business day if the email is sent on a weekend or public holiday.

20. Law and Jurisdiction

These terms and conditions and the relationship between you and Manchester Vacs shall be governed by and construed in accordance with the Law of England and Wales, and Manchester Vacs and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

Returns Policy.

Please note we do not accept change of mind returns for items bought in person, in store or for B2B (business to business) sales.

21. Manchester Vacs aims to always provide high-quality Goods that are fault free and undamaged. On occasion however, goods may need to be returned. Returns are governed by these Terms and Conditions. In the unlikely event that you need to return a part to us, please do not simply mail it to our shop address without making a prior arrangement. Some returns are to be delivered to our stores address which differs from our shop address.

Please speak to us in the event of any problem, especially before attempting to return any item, as it is unlikely to be received if our instructions are not followed. If there is a problem with any order from us, we recommend you speak to us on the telephone or >>email us<< in the first instance. We find problems are more easily resolved that way. We are quite friendly; we don't bite! We prefer to work with you to find mutually agreeable solutions to any problems that arise. 

Please note that we do not accept any 'change of mind' returns for any online sales after two weeks.

We also do not accept returns of DC brushroll motors, batteries or PCB/control modules at all - which is clearly noted on applicable shop listings, along with the reasons why, as a condition of sale. 

Business to Business (B2B Sales)

All commercial vacuum cleaners, parts for commercial vacuum cleaners, any parts designed to be fitted by the trade (whether bought for commercial use or not) and/or any other sales delivered to a commercial address shall be on a business-to-business basis (B2B). The statutory provisions available to consumers under the Sale of Goods Act 1979 (as amended) and other related consumer legislation such as Consumer Contracts Regulations do not apply to B2B sales. With B2B sales, goods are usually non-returnable; there is no automatic right for the buyer to return goods that are not faulty where they comply with the order. In the event we do decide to accept a discretionary return of an item from a B2B sale, we reserve the right to charge a variable restocking fee (typically 30%) to reflect the time spent dealing with the return and any resultant loss of value of the item if it has been opened (or packaging damaged) and can no longer be sold as new.

Consumer Contracts Regulations 2013

UK law offers non-commercial customers not buying items sold on B2B terms the following cancellation rights when you buy online:
  • You are entitled to cancel your order if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods (this no longer applies to vacuum cleaners that have been unpacked/used for hygiene reasons).
  • Your right to return products does not apply to goods made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned (PCB's, digital boards and DC motors for example, are sold as non-returnable [labelled as such in the item descriptions], which is industry standard) or are liable to deteriorate or expire rapidly.
  • If you wish to exercise your right of cancellation, you are obliged to take reasonable care of the goods and return them in good order.
  • To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, address, details of the order you wish to cancel and, your phone number and email address.
  • You can cancel by emailing us
  • If you decide to cancel, you should return the goods to us at your cost, preferably by a tracked service for your protection, within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This includes the cost of delivery (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery).
  • We may make a deduction from the reimbursement for loss in value of any goods supplied. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.
  • The Consumer Contracts Regulations 2013 do not apply to orders outside the UK. All non-UK sales are final.

Proof of Purchase.

As part of our green drive, receipts for parts orders are sent by email automatically immediately after order. We also send paper receipts with parts orders. If you need to contact us about a parts order, please the order number from the confirmation email. If you need a hard copy for your accounts, you can print that yourself from the e-receipt. In the event of a problem with an order, it is your responsibility to provide the order number and date from your e-receipt. Our staff are unable to look up Paypal transaction numbers - these are not order numbers.

With reconditioned machines, we do not send out paper guarantees anymore. All we need to look up any machine we have sold is the date of purchase, the model you bought, and the email address associated with the payment. In the event of a machine needing to be returned or a problem with a machine supplied, it is your responsibility to provide us with that information in order that we can trace the transaction.

Incorrect Orders

21.1 If you receive Goods that do not match those that you ordered, you should contact us within a reasonable time to arrange collection and return. You will be given the option to have the Goods replaced with those ordered (if available) or to be refunded. Refunds and replacements will be issued upon our receipt of the returned Goods.

Faulty Goods

21.2 If any Goods you have purchased have faults when they are delivered to you, you should contact Manchester Vacs within a reasonable time to arrange return or replacement. We request that if Goods need to be returned, that they be returned in their original condition with all packaging (where practicable) and any documentation. Where replacement goods are not immediately available from stock, the price of the Goods, as paid by you, will be refunded to you.

Guarantee Returns

21.3 If any Goods develop faults within their warranty period, you are entitled to a repair or replacement under the terms of that guarantee. There is a specific guarantee for reconditioned vacuum cleaners and Airblade hand dryers, which can be found >>here<<. Certain spare parts are not under warranty by Dyson, Sebo or the OEM as their policy is central to the fact they are not present at the time of fitting and thus cannot assess the expertise of the fitter.

Damaged on Delivery

21.4 If Goods are damaged in transit and the damage is apparent on delivery, you should not sign the delivery note and/or refuse the delivery. Please notify Manchester Vacs immediately on 0161 223 6814 if you have refused delivery for these reasons. Upon receipt of the returned Goods, replacement Good(s) will be dispatched, dependent on stock availability. Where replacement goods are not immediately available from stock, the price of the Goods, as paid by you, will be refunded to you.

21.5 If you wish to return Goods to Manchester Vacs for any of the above reasons, please contact us on 0161 223 6814 or >>email us<< to make the appropriate arrangements. Do not return goods without contacting us first.

21.6 Manchester Vacs reserves the right to exercise discretion with respect to any returns under these Terms and Conditions. Factors which may be taken into account in the exercise of this discretion include, but are not limited to:

21.6.1 Any use or enjoyment that you may have already had out of the Goods;

21.6.2 Any characteristics of the Goods which may cause them to deteriorate or expire rapidly;

21.6.3 If the condition of the goods returned is noticeably different to when they were sent. For example, if they are damaged, used, soiled or are different items altogether;

21.6.4 Any discounts that may have formed part of the purchase price of the Goods to reflect any lack of quality made known to the Customer at the time of purchase. Such discretion is to be exercised only within the confines of the law of England and Wales.
